ACCEPTABLE IDENTIFICATION
When completing an Acknowledgment or Jurat, a California Notary Public must establish the identity of the signer through satisfactory evidence of identification.
Common forms of acceptable identification include:
- California Driver’s License or Identification Card issued by the California Department of Motor Vehicles (DMV);
- United States Passport or U.S. Passport Card;
- Valid foreign passport issued by the signer’s country of citizenship;
- Valid Consular Identification Card issued by a consulate of the signer’s country of citizenship;
- Driver’s license issued by another U.S. state or by an authorized Canadian or Mexican public agency;
- Identification card issued by another U.S. state;
- United States Military Identification Card, provided it contains the information required by California law;
- Employee Identification Card issued by an agency or office of the State of California or by a California city, county, or city and county; or
- Identification Card issued by a federally recognized tribal government.
Certain forms of identification must be current or issued within the time period permitted by California law and must contain the identifying information required by law.
INMATE IDENTIFICATION
California law also permits certain forms of inmate identification.
An inmate identification card issued by the California Department of Corrections and Rehabilitation (CDCR) may be used when the inmate is in custody in a California state prison.
Any form of inmate identification issued by a Sheriff’s Department may also be accepted when the inmate is in custody in a local detention facility, subject to the requirements of California law.
DON’T HAVE ACCEPTABLE IDENTIFICATION?
California law also permits a signer’s identity to be established in certain circumstances through one or two credible witnesses who meet specific legal requirements.
If you are unsure whether your identification can be accepted, give us a call before your appointment and let us know what form of identification you have available.
ACKNOWLEDGMENT vs. JURAT — WHAT IS THE DIFFERENCE?
Two of the most common notarizations performed in California are an Acknowledgment and a Jurat. Although both require the signer to personally appear before the Notary Public and provide satisfactory evidence of identity, they serve different purposes.
ACKNOWLEDGMENT
An Acknowledgment is used when the signer acknowledges to the Notary Public that they signed the document voluntarily and in their authorized capacity.
The document does not have to be signed in front of the Notary Public. It may have been signed beforehand. However, the signer must personally appear before the Notary and acknowledge that they executed the document.
Acknowledgments are commonly requested for documents such as powers of attorney, deeds, real estate documents, contracts, authorizations, and other documents in which a signature must be acknowledged.
With an Acknowledgment, the Notary Public verifies the identity of the signer—not the truthfulness, accuracy, or validity of the document.
JURAT
A Jurat is different because the signer is making a sworn or affirmed statement.
For a Jurat, the signer must personally appear before the Notary Public, sign the document in the Notary’s presence, and take an oath or affirmation declaring that the statements contained in the document are true.
Jurats are commonly used for affidavits, sworn statements, declarations, and other documents that require the signer to swear or affirm to the truthfulness of their contents.
THE SIMPLE DIFFERENCE
Acknowledgment:
“I acknowledge that I signed this document.”
Jurat:
“I swear or affirm that the statements in this document are true.”
NOT SURE WHICH ONE YOU NEED?
A California Notary Public cannot select the type of notarization for you or provide legal advice about which notarial certificate your document requires.
If your document does not specify whether an Acknowledgment or Jurat is required, you should ask the person, attorney, agency, business, or government authority requesting the notarized document to tell you which notarial act is required.
Once you know which notarization you need, MISSION DOC PREP can take care of the rest quickly and professionally.
